As another commenter points out, Lancer's mythological death occurs after his violation of a taboo. Because of this, the moment he was offered hospitality, Lancer had no choice but to accept, as one of the taboos that end up killing him involves not refusing hospitality. (presumably, breaking a taboo would lead to severely weakened performance in following battle, leading to death).

Actually, under the circumstances of this meeting, Lancer CAN'T kill Shirou during at that time. The moment Lancer accepted Shirou's offer of refreshment, he placed himself under the laws of hospitality. And his legend includes a geas to never break those laws - if he does, he would be weakened to the point where he'd pretty much be guaranteed to die in his next battle (his death came because he was trapped in a situation where he could not avoid breaking that geas without breaking another, and died in battle after breaking geasa). So by accepting the tea, Lancer was pretty much required to delay killing Shirou until their next meeting at the earliest.
