First is that the King's Law and the King's Orders both have the same source and same authority, therefore an Order cannot violate a Law. In older government systems or the odd form of dictatorship the Earth-Bet United States operates under, this is just how things work. However, that viewpoint is incompatible with the rule of law that our real life United States and most other Western nations operate under. In those countries, the Law is the ultimate authority, and even a King is subordinate to it - as such, the King's Orders cannot override the Law. Government officials like to claim that things like constitutions and the rule of law are not suicide pacts, that they can be ignored if the reason is dire enough - though it's funny how the bar for direness keeps creeping lower and lower. But the problem with that viewpoint is that if the highest, most sacred, most inviolate law is not a suicide pact, then lower laws cannot be either. Worm is an excellent example of this at all levels of government. In that world like ours, might makes right no matter how the government tries to spin it, and there are individuals in that world powerful enough to sneer at entire Army divisons. |
